Hadis 5: Mencegah kemungkaran
مَنْ رَأَى مِنْكُمْ مُنْكَرًا فَلْيُغَيِّرْهُ بِيَدِهِ، فَإِنْ لَمْ يَسْتَطِعْ فَبِلِسَانِهِ، فَإِنْ لَمْ يَسْتَطِعْ فَبِقَلْبِهِ، وَذَلِكَ أَضْعَفُ الْإِيمَانِ
Rasulullah bersabda: Sesiapa di antara kamu melihat sesuatu kejahatan, maka hendaklah ia mengubahnya dengan tangannya, sekiranya tidak sanggup hendaklah dengan lisannya, dan sekiranya tidak sanggup hendaklah dengan hatinya yang demikian itu (mengingkarkan dengan hati) adalah selemah-lemah iman. Ini bererti, sesiapa yang membiarkan saja kejahatan, bererti kosong sudah Iman nya. Tetapi kalau membenarkan kejahatan itu berlaku, bererti iman nya negative, bererti murtad sudah. Jadi awas awas lah dengan tindakan kita. Yang penting, kita benci kepada kejahatan dalam hati untuk menghindar diri kita jadi murtad.

Dalam sebuah hadis yang diriwayatkan oleh Ibnu Umar bahawa Rasulullah s.a.w bersabda menceritakan akan maksud dayus :
قالوا يا رسول الله وما الديوث قال من يقر السوء في أهله
Ertinya : Apakah dayus itu wahai Rasulullah ?. Jawab Nabi : Iaitu seseorang ( lelaki) yang membiarkan kejahatan ( zina, buka aurat, bergaul bebas ) dilakukan oleh ahlinya ( isteri dan keluarganya)
Di Google Translate:

Ertinya, dalam kurungan adalah tafsiran tambahan. Hadis tidak sebut lelaki. Hadis cuma sebut kejahatan, bukan setakat zina.
Perkataan asal adalah ahli sahaja. Keluarga, lain perkataan.

Saya perhatikan bahawa budaya di Malaysia ini, membiarkan kejahatan berlaku tanpa apa apa tindakan pun. Kerajaan nya pun membenarkan orang menipu pekerja dan pembeli dengan memberikan maklumat palsu.
Seperti yang di terangkan oleh hadis ini, perbuatan ini adalah dosa yang berat sebab sudah jadi murtad sebab Imam nya jadi tolak sudah.
Kalau pembeli, kita masih ada pilihan, jadi boleh buat siasatan. Selepas beli, masih boleh kembalikan atau minta gantirugi kalau tidak berpatutan dengan harga dan maklumat yang di beri.
Dari segi pekerjaan, tidak ada cara meminta gantirugi kalau kita dapati diri kita di tipu oleh majikan. Saya dapat rasai dari layanan syarikat ehailing Grab dengan pemberian kerja secara otomatik tanpa pilihan untuk menolaknya. Boleh di tolak, tapi di denda dan ada yang di buang kerja sebab banyak kali menolak. Walaupun konon nya membenarkan menolak, tidak dibenarkan alasan kerugian. Bererti, walaupun di beri bayaran yang amat merugikan, sehingga kurang dari harga petrol, tidak boleh menolak juga. Ini adalah bukti jelas bahawa Grab mengamalkan penghambaan moden, dan kerajaan Malaysia yang konon nya mengamal prinsip Islam, biarkan saja.
Mungkin juga disebabkan rakyat Malaysia ini bersifat dayus, iaitu membenarkan kejahatan berlaku terhadap diri mereka tanpa membuat aduan. Cukup dengan berhenti kerja saja. Ini adalah salah. Setiap kejahatan mesti di denda. Kita tidak boleh biarkan kejahatan di ulangi kepada orang lain juga.
Saya pun tertipu. Saya percaya pada permulaan bahawa Grab akan menjaga kepentingan pekerja nya, iaitu pemandu pemandu nya. Rupanya tidak. Sebab itu saya kumpulkan bukti dan hantar aduan kepada pehak berkuasa. Malangnya, kementerian yang di pertanggungjawabkan menjaga kepentingan pekerja, langsung tidak mahu terima aduan pekerja. Konon ada email, tapi tidak boleh hantar pun kepada e-mail tersebut. Jadi saya hantar kepada JPM, bahagian Human Resource. Tengok lah apa jadi sebab aduan akan di hantar kepada bahagian yang berkenaan.
Modern Slavery at Grab eHailing

On Sunday, 19 Feb, 2023, I worked from 8:30 AM until 7 PM, and earned RM78.90. The distance I travelled was 200 km. I used a 2016 Proton Iriz with low mileage of only 70,000 km, and manual transmission.
Petrol consumption cost was 20 sen per km. Rental cost can be estimated to be 15 sen per km although rental companies charge higher than 25 sen per km to profit.
The total cost was 35 sen x 200= RM70.00. My salary was therefore only RM8.90 for a 12-hour work.
Grab is therefore practicing modern slavery by paying much less than the minimum salary. The minimum pay should be RM7.80 per hour. I noticed that PH paid their election workers at this rate and this is honourable.
Now that PH is in government, it is time for PH to enforce the minimum salary even to eHailing companies, by not allowing them to charge 20% commission when their drivers lose money.
On 27 Feb 2023, Tuesday, I travelled for 25km, from 9:20 to 10:30. Tips was RM4, so actual Grab payment was RM15.30. Deducting costs at 35 sen per km, RM8.75, actual payment was RM6.55, for a total time of 1 hour 10 minutes, which is still below the minimum pay rate of RM7.80 per hour.
This is the best case scenario for me. At most times it is less than this.
The reason can be seen at each trip. The journey time is usually 20 minutes when there is no traffic jam. At each trip, I was paid by Grab, after deducting costs, of RM3.30. The hourly rate is therefore RM9.90 per journey without taking into account time to pick up passengers. This information is available to Grab so Grab knows that it is paying their drivers at below the minimum pay.
Grab gives no choice to drivers reject the order and worse, lied to the drivers regarding the actual payment rate by giving misleading information. Therefore, Grab intentionally breaks the minimum pay requirements and other modern slavery violations.
Grab appears to allow drivers to reject bookings, even after automatic acceptance, but the reasons allowed is only delay in reaching on time. Drivers have to lie to reject losing and even dangerous bookings.
Solutions
Reduce commission rate from 20% to 10% for trips where the profit rate is less than the minimum pay rate including the time to pickup the passenger.
Give information on the actual profit for the trip, not just revenue. Start by training and reminding drivers on how to calculate their profits per trip and allow drivers to reject bookings based on low profitability.
Grab must pay penalties for past violations of the minimum pay requirements. Investigations must be carried out to other eHailing companies as well. Penalties should not be too high to bankrupt the company, just reduce their profits from the driver’s labour.
Why Enforcement of Minimum Wage Good for Malaysia
The public can have a convenient public transportation by using eHailing. If drivers become poor and unhealthy because of the extremely low pay, less people will want to become drivers.
In Kudat, there is not even a single eHailing service. In Sandakan, only Maxim is available. Even in Ketiau, at the outskirt of Kota Kinabalu, only Maxim is available. In Melaka, at night only Maxim is available.
Maxim manages to survive because it allows drivers to choose trips and fares. Still, Maxim had been guilty of exploiting their drivers in the past.
